Causes mainly tightness of the muscles, in both the arms and legs of the inflicted. The arms will tend to be flat against the side of the body with the hands bent up against the forearm. Depending on the damage the legs will either be greatly effected or only mildly it may be only slightly obvious that there is a problem when the child walks or in worse cases both legs are affected and they will be crossed with the toes pointing. Employment Law - Restriction of Proceedings Order - Vexatious Claims

By Rosanna Cooper The case of Attorney General v Deman [2006], involved vexatious proceedings being brought before the Employment Appeals Tribunal. The respondent was born and educated in India but had US citizenship. He was employed as an academic economist. Between 1996 and 2005 he brought at least 40 claims before the employment tribunal. The great majority were claims for racial discrimination arising out of the refusal of an academic institution to short list or appoint him for a position for which he had applied. In most of the claims, the respondent alleged both primary discrimination and victimisation. The claims for victimisation mostly reflected the fact that the respondent believed that his history of litigation had become widely known and had been held against him. Most of the proceedings had been unsuccessful and many had had lengthy and complex interlocutory histories and had resulted in very long hearings. The respondent’s behaviour had been the subject of considerable criticism by a number of employment tribunals. The decisions of the tribunals had been the subject of at least 40 appeals to the Employment Appeals Tribunal. The Attorney General (the applicant in this case) applied under s.33 of the Employment Tribunals Act 1996 for a restriction of proceedings order against the respondent, in order to try to restrict the wasting of court time. It was held that, on the facts, the respondent could be said to have acted vexatiously and to have done so habitually and persistently. With regards to the primary discrimination claims, in no case did the respondent have any worthwhile positive evidence to suggest that a decision in question was taken on racial grounds. Nor was there any statistical evidence supporting him in anyway. Regarding victimisation, a claim was made indiscriminately in virtually every case, irrespective of the individual facts or of any reason to suppose that the respondents to those claims knew anything of his history. In making the applications in question for the posts at the academic institutions, the respondent was decreasingly concerned with achieving appointment and increasingly concerned with pursuing a campaign to demonstrate what he believed was discrimination in the world of higher education. It appears that the great majority of the claims brought had little chance of success. In the circumstances, the proceedings were held to have been brought vexatiously. Those proceedings included appeals brought before the Employment Appeals Tribunal. The outcome of the case was that the courts discretion was exercised in granting a restriction of proceedings order against the respondent. It was further held that there were no grounds for giving the restriction of proceedings order a finite term, and so continues indefinitely. When you watch TV and see how our society has fallen into the gutter of wickedness, does it discourage you? Have you had people you trusted, test your faith with the choices they have made and the bad things they do or have done to you? Well then, welcome to the latter days! Our prophets have predicted our times. Now is Satans time. It is very evident as we all experience the downfall of society.How do we endure to the end, keep our faith and convictions strong so we will be numbered with the righteous when our Savior Jesus Christ returns? #1 We must realize these are the last days. We cannot be blind and think that the evil things we see all around us will just go away. We dont have to sit idly by and watch bad things happen. We cant allow the evil to enter our lives or our familys lives. We cannot let it get any kind of hold on us and we cannot allow it to destroy us. We are in a war between good and evil and Satan plans to win the war. He hopes to get a chain around your neck with the evil he spreads and then pull you right down to hell. We must have our eyes wide open and protect ourselves and our families from his enticing and from his temptations. In these days Satan will make evil things seem good and good things seem evil. We must be very close to our Father in Heaven and his Son Jesus Christ so we know the difference. What must we do? #2 We must watch and pray always Mark 14:38 Watch and pray, lest ye enter into temptation. This is the time when we must read our scriptures regularly, pray regularly, go to church, love each other, be obedient, serve others and make righteous choices and choose to be pure and clean. It is a time for repentance! To choose to be like Jesus! We must be careful. I have seen through the years those who have lot their faith and quit going to church because of something someone said or did and lost their testimonies and their families and after many years are now trying to return. I have seen many who made the wrong choices and let Satan enter their life and lost the spirit. We must hold on to the Iron Rod! In this world we cant let go for a minute because Satan will have us. At the county fair I saw some motor riders (motorbikes) going over jumps and for a few seconds would completely let go of their bikes and be in mid air. I never saw one of them fall but if their timing wasnt perfect they would probably kill themselves from the fall. We cant let go of the iron rod of the Gospel of Jesus Christ for a second, because if we do we may be dead! #3 We must do all we can to fight against Satan and stop the evil A good man said: We are not hopeless. There are many good people in the world. There is no need to stand still and let the filth and violence overwhelm us or to run in despair. There are enough good people in the world and in our churchs to add their strength to the few who are now effectively working. The challenge to oppose this evil is one from which we cannot shrink.How do we fight Satan and this evil? We begin with our selves. We must live virtuous lives. We are children of God, created in his image and we have his Son, Jesus, our Savior to follow, to learn from and become like. We must be pure before we can make a difference. We must be good examples. We must look for the good things in life. Choose not to use drugs and alcohol or drugs. BMI is calculated by dividing a person’s weight (in kilograms) by his or her height (in meters, squared). Calorie. A unit of measure for the amount of energy released when the body breaks down food. Carbohydrate. Any of a large group of sugars, starches, cellulose and gums that the body uses by converting into glucose, a simple sugar, for fuel. Cascara. A common ingredient used in weight loss products. One of the few herbs approved by the FDA as an over-the-counter drug. It is a strong stimulant laxative. Catecholamine. A chemical in the brain that affects mood and appetite. Chitosan (KITE-o-san). A dietary supplement made from chitin, a starch found in the skeleton of shrimp, crab and other shellfish. It has not been shown to contribute to permanent weight loss. Cholesterol. A type of fat that circulates in your blood. It comes from two sources. the body makes its own regardless of what is eaten and from foods containing animal products. Dietician or Dietitian. A person who specializes in the study of nutrition. Diuretic. A drug that promotes the formation of urine by the kidney. Diuresis. Water loss Duodenum. The beginning portion of the small intestine. Ephedrine (Ma-Huang). A common ingredient in herbal dietary supplements used for weight loss. Ephedrine can slightly suppress your appetite, but no studies have shown it to be effective in weight loss. Ephedrine is the main active ingredient of ephedra. Ephedra is also known as Ma Huang, not ephedrine. High doses of ephedra can cause very fast heartbeat, high blood pressure, irregular heart beats, stroke, vomiting, psychoses and even death. Extensive Gastric Bypass. A gastric bypass operation in which portions of the stomach are removed. The small pouch that remains is connected directly to the final segment of the small intestine, thus completely bypassing both the duodenum and jejunum. Fat. Organic compounds that are made up of carbon, hydrogen, and oxygen, it is the body’s most concentrated source of energy. Like protein and carbohydrates, fat is a principal and essential component of the diet. Fat Absorption Inhibitor. Medications that work by preventing the body from breaking down and absorbing fat eaten with meals. Food and Drug Administration (FDA). Government agency whose mission is “to promote and protect the public health by helping safe and effective products reach the market in a timely way, and monitoring products for continued safety after they are in use.” Food Triggers. A situation or emotion that causes a person to eat such as stress or depression. Gastric Banding. A surgical procedure in which a band made of special material is placed around the stomach near its upper end, creating a small pouch and a narrow passage into the larger remainder of the stomach. Gastric Bypass. A type of operation that combines the creation of a small stomach pouch to restrict food intake and the construction of bypasses of the duodenum and other segments of the small intestine to cause malabsorption (decreased absorption of nutrients). Glucomannan. Made from the root of Amorphophallus Konjac, an herbal supplement that is said to contribute to weight loss by delaying the absorption of glucose from the intestines. Guarana. A nervous system stimulant derived from the seeds of a Brazilian plant of the same name, it is often found in herbal supplements that promote weight loss. Guar Gum. Also known as guar, guar flour, and jaguar gum, it is a dietary fiber obtained from the Indian cluster bean. Used extensively as a thickening agent for foods and pharmaceuticals, it is commonly sold as an herbal supplement to promote weight loss. High Protein Diet. Diets that recommend receiving up to 30% of calories (or more) from protein as opposed to the recommended 10%-15% from protein. These diets also recommend low carbohydrate consumption and are often high in total fat. Hydrostatic Body Fat Testing. A body composition test performed by submerging the person in water and then measuring his or her underwater weight. Jejunum. The middle section of the small intestine. Ketone. Waste products in the body that are a result of fat burning. Ketosis. An abnormality of the body’s metabolic process, resulting in an increase of ketones in the blood, which can increase the risk of developing kidney stones. Ketosis is prevented by eating at least 100 grams of carbohydrates a day. Ma-Huang. See ephedrine. Meridia. See Sibutermine Metabolism. The amount of energy (calories) your body burns to maintain itself. Metabolism is the process in which nutrients are acquired, transported, used and disposed of by the body. Monounsaturated fat. A type of fat found in large amounts in foods from plants, including olive, peanut and canola oil. Mortality. The rate of death. Obesity. An excess proportion of total body fat. The most common measure of obesity is the body mass index (BMI). Orlistat. A commonly prescribed fat absorption medication, it is sold under the brand name Xenical. Phen-fen. A weight loss drug made up of fenfluramine and phentermine. Its use has been linked to heart valve problems and has been banned by the FDA. Phenylpropanolamine (PPA). Once a common weight loss ingredient in appetite suppressants, recent studies have linked PPA to an increased risk of stroke. The FDA warns consumers to avoid use of products containing PPA. Polyunsaturated Fat. A type of fat that is found in large amounts in foods from plants, including safflower, sunflower and corn oil. Protein. An organic compound that is the “building block” of the human body. Protein builds and maintains muscle tissue. Pyruvate. Formed in the body during digestion of carbohydrates and protein, some studies indicate that it may help with weight loss. Although it appears to be safe, claims of boosting metabolism, decreasing appetite and aiding in weight loss require further study. Recommended Daily Allowance (RDA). The level of essential nutrients required to adequately meet the known nutrient needs of practically all healthy persons, according to the Food and Nutrition Board of the National Academy of Sciences. Restriction Operation. The type of surgery most often used for producing weight loss. Food intake is restricted by creating a small pouch at the top of the stomach where the food enters from the esophagus. Examples of restriction operations include. gastric banding and vertical banded gastroplasty. Roux-en-Y Gastric Bypass (RGB). The most common gastric bypass procedure. First, a small stomach pouch is created by stapling or by vertical banding. This causes restriction in food intake. Next, a Y-shaped section of the small intestine is attached to the pouch to allow food to bypass the duodenum as well as the first portion of the jejunum. Saturated Fat. A type of fat most often found in animal food products including milk, eggs, meat and butter. Saturated fat is also found in vegetable products such as coconut and palm oil. Studies show that too much saturated fat in a person’s diet increases heart disease risk. St. John’s Wort. An herb that is primarily used as an antidepressant due to its effects on serotonin. There is limited research indicating its use for weight loss. Serotonin. A neurotransmitter found in the brain that affects mood and appetite. Sibutramine. A common prescription appetite suppressant, it is sold under the brand name Meridia. Vertical-Banded Gastroplasty. The most frequently used restrictive operation for weight control. During it, both a band and staples are used to create a small stomach pouch. Very Low Calorie Diet (VLCD). A short-term weight loss diet, VLCDs are commercially prepared formulas of 800 calories or less that replace all usual food intake. Not all VLCD need be formulas; they could just be low calorie meal plans. These diets (in fact most diets less than 1000 calories) are low in essential nutrients and require vitamin/mineral supplementation. Xenical. See Orlistat Yerba Mate. Also known as Paraguay tea, this strong central nervous system stimulant is often sold as a dietary supplement. It has not been proven to cause weight loss. Weight Cycling. The repeated loss and regain of body weight. When weight cycling is the result of dieting, it is often called “yo-yo” dieting.
